Terms of Service

Welcome. These Terms of Service (“Terms”) govern your use of the services provided by Voltaris Labs LLC (“Voltaris Labs”, “we”, “us”, or “our”), including website design, development, hosting, and related services (collectively, the “Services”). By purchasing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By engaging our Services, you confirm that you are at least 18 years old, authorized to enter into a binding contract on behalf of yourself or your business, and agree to comply with these Terms.

2. Description of Services

Voltaris Labs provides custom-built websites for local service businesses, primarily in the HVAC, plumbing, roofing, electrical, landscaping, and construction trades. Our Services include but are not limited to:

• Website design and development
• Content copywriting and layout
• Hosting and SSL certificate management (if elected)
• Ongoing edits and maintenance (if elected)
• Basic search engine optimization setup

3. Fees, Payment, and Refunds

Pricing for each Service is stated on our website at voltarislabs.ai or communicated to you directly prior to purchase. All fees are quoted in United States Dollars (USD) and are processed by third-party payment providers.

Setup fee: The one-time setup fee is due before we begin production work on your site.

Recurring hosting: If you subscribe to our managed hosting plan, monthly charges are billed automatically until you cancel. You may cancel at any time and will retain your site code.

30-day lead guarantee: If your new production website does not generate at least one inbound lead within the first 30 days of going live, you may request a full refund of your setup fee. Refund requests must be submitted in writing (SMS or email) within 30 days of the site launch date.

4. Ownership and Intellectual Property

Upon full payment of the setup fee, you own the source code of your website, including all custom content, imagery you supplied, and configuration files specific to your business. You may take the code to any hosting provider at any time.

Voltaris Labs retains ownership of any proprietary tools, frameworks, templates, or components used across multiple client projects. Nothing in these Terms transfers ownership of our underlying build system.

5. Client Content and Warranties

You warrant that any content you provide to us, including business names, logos, photos, copy, testimonials, and reviews, is either owned by you or properly licensed for the use we make of it. You agree to indemnify and hold Voltaris Labs harmless against any third-party claim arising from content you provide.

6. Third-Party Services

Your website may integrate with third-party services (for example: Google Maps, Google Analytics, form submission providers, payment processors, or hosting infrastructure). Voltaris Labs is not responsible for outages, data policies, or fees imposed by these third parties.

7. Warranty Disclaimer

The Services are provided “as is” and “as available”. While we take reasonable steps to ensure your site functions properly, we do not warrant that the Services will be uninterrupted, error-free, or that they will meet all your business objectives.

8. Limitation of Liability

To the maximum extent permitted by law, Voltaris Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities, arising out of or in connection with your use of the Services. Our total liability to you under these Terms will not exceed the total amount you paid to us in the twelve months preceding the claim.

9. Termination

You may cancel any recurring subscription at any time by texting or emailing us. On cancellation, we will hand over your site code and cooperate with a reasonable transition to another provider. We reserve the right to suspend or terminate Services for non-payment, abusive behavior, or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Cuyahoga County, Ohio.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Material changes will be communicated by email or SMS to active clients. Continued use of our Services after changes take effect constitutes acceptance of the updated Terms.
